Terms of Service

These Terms of Service (“Terms”) govern your use of Hubbo, a service operated by Codemilk, ul. Osiedle Nad Jarem 115, 83-200 Starogard Gdański, Poland (“Codemilk”, “we”, “us”). By creating an account or using the service you agree to these Terms. If you use Hubbo on behalf of a company, you confirm that you may bind it.

1. The service

Hubbo provides tools to show notifications, collect NPS and survey responses, publish a roadmap and a status page, and manage conversations with visitors. The service is accessed through a script that you embed in your website and through the admin app at app.hubbo.io. Features, limits and prices are described on hubbo.io and in the Help Center and may change over time.

2. Accounts

• You must provide accurate information and keep your login credentials safe.
• You are responsible for activity under your account, including the actions of team members you invite.
• You must be at least 18 or have the legal capacity to enter a contract.
• Notify us promptly at support@hubbo.io if you suspect unauthorized access.

3. Plans, billing and usage

• Hubbo offers Free, Standard and Premium plans. Paid plans are billed monthly or yearly in advance through Stripe, at the prices shown when you subscribe.
• Each plan includes allowances such as page views (unique browser sessions), NPS responses, accounts and team members. If you exceed an allowance, the affected features may stop working until you upgrade or the allowance resets.
• You may not circumvent or tamper with usage counting.
• You can cancel your subscription at any time from the admin app. Cancellation takes effect as described in the app, and your account then returns to the Free plan with its limits. Amounts already paid are not refunded unless required by law or stated otherwise at purchase.
• We may change prices or plan contents with reasonable notice. Changes do not affect a billing period you have already paid for.

4. Your content and your visitors’ data

• You own the content you create in Hubbo, such as notifications, surveys, roadmaps and status updates. You grant us a limited licence to host, display and process it only to provide the service.
• Data that Hubbo collects from your website visitors belongs to you. You are the controller of that data and we process it on your behalf, see Data processing.
• You must have a lawful basis, and give notices and obtain consents where required, for collecting visitor data through Hubbo on your website.
• Content you publish in Hubbo may be public. Do not publish secrets or personal data of others without a right to do so.

5. Acceptable use

You agree not to:

• use Hubbo for unlawful, deceptive, harassing or infringing content, or to send spam;
• attempt to access data or accounts that are not yours, or probe or disrupt our systems;
• submit fake NPS or survey responses or otherwise manipulate collected data;
• reverse engineer or resell the service, except as permitted by law;
• use the service to monitor or collect special categories of personal data unless you have a lawful basis and have told us in advance;
• create load that is unreasonable for your plan.

6. Availability and support

We aim to keep Hubbo available and to fix problems quickly, but we do not guarantee uninterrupted or error-free operation. We may perform maintenance, and some features may be changed or retired. Support is provided by email at support@hubbo.io. Features marked as “coming soon” are not part of the service until released.

7. Third-party services

Hubbo relies on providers such as authentication, payments, hosting and an AI model for NPS analysis. Their terms may apply to their part of the service. Your website and its visitors are your responsibility: Hubbo is not liable for how you use the widget on your site.

8. Intellectual property

Hubbo, its software, design and documentation belong to Codemilk or its licensors. Except for the right to use the service under these Terms, no rights are transferred to you.

9. Suspension and termination

• You may stop using Hubbo and delete your accounts at any time.
• We may suspend or terminate access if you materially breach these Terms, if required by law, or to protect the service and other users. We will try to give notice when it is reasonable to do so.
• After termination you may request your data export by emailing support@hubbo.io within a reasonable time. We may delete the data of closed accounts after a period.

10. Disclaimers and liability

The service is provided “as is” and “as available” to the extent permitted by law. To the extent permitted by law, Codemilk is not liable for indirect or consequential loss, loss of profit, data or goodwill, and its total liability arising out of the service in any twelve-month period is limited to the fees you paid for that period. Nothing in these Terms limits liability that cannot be limited by law, including mandatory consumer rights.

12. Changes to these Terms

We may update these Terms. If a change is material we will notify you, for example by email or in the admin app. Continued use after the change takes effect means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of Poland. Disputes will be handled by the competent courts in Poland, without prejudice to mandatory consumer protection rules that give you the right to bring proceedings in your country of residence.
